Beta Terms

These terms apply to use of the Winnow free beta (the “Service”) provided by an individual operating the Winnow service in a personal capacity (the "Operator"). The Service currently accepts no payments and offers no paid plans or paid services.
1. Nature of the Service — what it provides and does not provide
The Service provides a relative signal for review priority among images you submit for images submitted by users.
The Service does not provide:
- a determination that an image is defective;
- a decision that it is suitable for advertising or publication; or
- a warranty of accuracy, completeness, or currency.
You make the final decision on final review and whether to publish. You are responsible for the consequences of deciding whether or not to follow the Service’s ordering results.
The analysis uses models from an external AI provider. AI output may contain errors or omissions, and results for the same image may differ depending on when they are processed and which model is used.
2. Eligibility
Persons under 14 years old may not use the Service. You are responsible for providing accurate account information and for managing your account and authentication method.
3. Warranties and responsibility for your submissions
For every image, reference image, and brief (the "Submission") that you submit, you warrant that you:
- have the lawful authority to submit it to, and have it processed by, the Service;
- will not infringe a third party’s copyright, trademark, portrait rights, or trade secrets, or violate a third party's personal-information rights or applicable personal-information laws; and
- will not violate applicable law or these terms.
If your breach of these warranties causes loss to the Operator or gives rise to a third-party claim or dispute, you will bear reasonable defense costs and compensate the Operator for direct loss within the scope of your fault. If the Operator wishes to settle with a third party, the Operator will consult with you in advance.
4. Prohibited use
- Submitting images that infringe another person’s rights
- Submitting content prohibited by law, including child sexual exploitation material or illegally recorded material
- Using automated means to bypass usage, cost, or authentication controls
- Attempting to discover vulnerabilities, overload the Service, or reverse engineer it
- Representing the Service’s output to a third party as carrying a warranty the Service does not provide, such as a suitability determination
The Operator may immediately restrict or temporarily suspend your use of the Service to the extent necessary to protect against rights infringement, security threats, or service instability based on objective circumstances. Termination will only occur if a material violation is confirmed and not corrected after an opportunity to do so. However, if immediate action is required, the Operator will notify you of the reason and how to object without delay afterwards.
Restriction, suspension, or termination of use does not itself mean the immediate deletion of Submissions or processing records; retention and deletion are governed by the Privacy Policy.
5. Beta nature — changes and discontinuation
The Service is a beta, and its features, usage allowance, and performance may change or be discontinued subject to the notice procedure below. The Operator may change or discontinue all or part of the Service when necessary for beta operation, security, legal compliance, external provider circumstances, or service stability.
- A change adverse to you or termination of the Service will generally be notified 30 days in advance through the Service or the email registered at sign-up.
- Other changes will be notified 7 days in advance.
- Where there is an urgent reason, including an outage, security incident, legal compliance, circumstances of an external provider, or exhaustion of an external provider’s cost cap, the Operator may act first and notify you without delay.
The free beta’s usage allowance and eligibility requirements are set out in this section. Anonymous users without an account are provided, separately from the allowance for a signed-up account, a beta usage allowance of up to 10 images per 24 hours. A signed-up account receives an allowance of 200 images once during the lifetime of the account. Free beta usage allowance is provided within an overall cap set by the Operator; if that cap is exhausted, the grant of any remaining, ungranted usage allowance may be suspended. Failed processing and errors do not deduct from the usage allowance.
Users who participate in the survey guided by the Operator on the Service screen and whose participation code linked to their account is validly confirmed will be granted an additional beta usage allowance of 100 images once. Benefits are not provided during periods when the survey is not ready, and provision is processed after confirming the response.
6. Availability
The Service is provided as-is. The Operator does not warrant uninterrupted availability or completion within a particular processing time. The Service runs in the current browser tab; closing or reloading the tab loses work in progress and results.
7. Liability
Except in cases of willful misconduct or gross negligence, the Operator is not liable for:
- loss caused by an outage of an external provider itself, regardless of the Operator's willful misconduct or gross negligence;
- loss caused by a publication or execution decision you make based on the Service’s ordering result;
- loss arising because your submission infringes a third party’s rights; or
- loss of results because you close or reload the browser tab.
The Operator’s liability for damages is limited to the extent permitted by applicable law. This clause does not apply to the extent it conflicts with mandatory consumer-protection provisions; the remaining portions remain effective in that event.
8. Personal information
The items, purposes, retention periods, and cross-border transfers of personal information are governed by the Privacy Policy. The Service does not permanently store the submitted original image bytes in the Service’s data stores. Information transmitted to external processors during processing and its retention are governed by the Privacy Policy. Ordering results and image hashes are retained for the periods stated in the Privacy Policy.
9. Termination by you
You may terminate the service agreement at any time by requesting account deletion. The deletion process and deadline are governed by the Privacy Policy.
10. Changes to these terms
The Operator may change these terms and will follow the notice procedure in Section 5. The Operator will clearly notify you, along with the notice under Section 5, of the changes, reasons, effective date, and that you are deemed to have agreed to the changes if you continue to use the Service without objecting or terminating by the effective date. If you do not agree, you may request account deletion before the effective date.
11. Governing law and disputes
These terms are governed by the laws of the Republic of Korea. Disputes relating to the Service will first be addressed through consultation at winnow@jhlim.dev; if consultation does not resolve the dispute, either party may bring the dispute before a court with jurisdiction under the Korean Civil Procedure Act.
